Marbella approves its new municipal planning framework
What it means for building and buying, without granting blanket permission to build.
21 September 2026
On 18 September 2026, Marbella gave final approval to its new Plan General de Ordenación Municipal (PGOM). The plan updates the municipality's spatial planning strategy, which had until now relied on a general framework dating from 1986. This is a significant development for prospective buyers and those planning to build. Opportunities must nevertheless be assessed for each location. [1] [2]
Which plan has actually been approved?
The PGOM sets out Marbella's broad development strategy: the organisation of its territory, major infrastructure and areas for future growth. It is a municipal spatial planning instrument, not a subdivision plan or a permit for an individual building project. According to the council, it is the first PGOM in Andalusia adapted to the new planning law, LISTA. [1] [4]
The more detailed rules for urban land are to be set out in the Plan de Ordenación Urbana (POU), covering matters such as land use and building parameters. This second plan was still being prepared when the PGOM was approved. New urban extensions may also need separate plans, such as a Plan Parcial. [3] [5]
Approval and entry into force are not the same
The decision of 18 September constitutes final approval by the municipal council. However, the plan's legal effect also depends on registration and the required official publication of the decision and planning regulations. Its exact entry-into-force date must therefore be checked against that publication; it cannot simply be inferred from the date of the press release. [3]
The key distinction: the general planning framework has been updated. Whether anything may be built on a particular plot, and what may be built there, remains a separate question.
